This Privacy Policy explains how Hyperscene, Inc. (“Hyperscene,” “we,” “us,” or “our”) collects, uses, and shares personal information when you use Superscenic — our mobile app, our website at superscenic.app, and related services (together, the “Service”).
1. Information We Collect
Account information. When you create an account, we collect your name and email address. You may also add optional profile information, such as a username, photo, or bio.
Recordings. When you submit a recording, the app uploads to our servers:
- images from your camera;
- depth maps, if supported by your device;
- camera poses, parameters, and configuration; and
- the location of the recording, if you have authorized the app to do so.
Scenes. When you upload a recording, we create a “scene” for it. A scene consists of the 3D content we generate from the recording (such as Gaussian splats) together with any titles, descriptions, and other information you add to it. A scene exists even if processing of the recording has not completed or was unsuccessful.
Purchase information. Subscriptions are billed by Apple through the App Store. We receive information needed to provide your subscription — such as your plan, subscription status, and transaction identifiers — but we never receive your payment card details.
Device and connection information. When you use the Service, we automatically receive certain technical data such as your IP address, device model, operating system version, and account identifier.
Usage information. We collect information about your use of the Service, such as the features you use and actions you take in the Service.
Diagnostic data. When the app crashes or encounters an error, we may collect crash traces, device state, device model, and OS information so we can diagnose and fix the issue.
Communications. If you contact us, we keep the correspondence and the information in it.
Cookies. The superscenic.app website uses cookies to keep you signed in and to secure your session. We do not use advertising or third-party analytics cookies. Our website does not track you across other sites or services, regardless of whether your browser sends a “Do Not Track” or similar signal.
We collect this information from you and your device, or receive it from your sign-in provider (such as Apple or Google) or from Apple in connection with your subscription.
2. How We Use Information
We use the information we collect to:
- Provide the Service — generate 3D content for your scenes; host your scenes and profile; let you view, export, and share scenes; and manage your credits and subscription;
- Communicate with you — send service-related messages, respond to support requests, and, with your consent, send occasional product news;
- Keep the Service safe — authenticate you, prevent fraud and abuse, enforce our Terms of Service, and secure our systems;
- Improve the Service — debug crashes, fix bugs, understand how features are used, develop new features, and improve existing features; and
- Comply with law — meet our legal obligations and establish, exercise, or defend legal claims.
3. How We Share Information
We do not sell your personal information and do not share it for targeted advertising. We share personal information only:
- With service providers that process it on our behalf and under our instructions to support functions such as hosting, storage, crash reporting, and subscription management;
- With other users and the public, at your direction — scenes you share by link are visible to anyone with the link, and scenes you share publicly appear on your profile, may be included in feeds, and are visible to all users and visitors. Shared scenes are displayed together with your profile information (such as your username and photo);
- For legal reasons — if we reasonably believe disclosure is required by law or legal process, or necessary to protect the rights, safety, or property of Hyperscene, our users, or others;
- In a business transfer — if Hyperscene is involved in a merger, acquisition, financing, or sale of assets, personal information may be transferred as part of that transaction. Any acquirer or successor will be bound by this Privacy Policy; and
- With your consent — in any other case, we will ask you first.
4. Data Retention
We generally retain your personal information for as long as it is necessary to provide the Service.
Content you delete. When you delete a scene, it is removed from the Service immediately, and we permanently delete the scene and its recording from our systems within 30 days.
Account deletion. If you delete your account, or your account is otherwise closed, we immediately remove all of your scenes and your profile from the Service. Your scenes, the corresponding recordings, your profile, and account information are permanently deleted from our systems within 30 days.
In either case, we may retain limited information longer where necessary to comply with legal or contractual obligations, keep the Service safe, prevent fraud and abuse, or resolve disputes — for example, transaction records or records of abuse. We may also keep de-identified or aggregated data that cannot reasonably be linked to you after your personal information has been deleted.
5. Your Rights and Choices
We offer the same core privacy rights to everyone, wherever you live. You can:
- Access and export your personal information, including downloading your scenes from the app;
- Correct inaccurate account or profile information;
- Delete individual scenes, or your entire account, in the app;
- Opt out of marketing emails via the unsubscribe link in any such email; and
- Object to or restrict certain processing, or withdraw consent where processing is based on consent, without affecting processing that happened before withdrawal.
To exercise any of these rights, use the in-app controls or email privacy@superscenic.app. We may need to verify your identity (for example, by confirming control of the email or sign-in associated with your account) before acting on a request, and we will respond within the time required by applicable law. We will not discriminate against you for exercising your rights. Where applicable law allows, an authorized agent may submit a request on your behalf.
If you are not a Superscenic user and believe that content on the Service contains your personal information — for example, imagery of you or your home — contact us at privacy@superscenic.app. We will review your request and remove or restrict the content where appropriate or required by law.
6. Security
We use reasonable technical and organizational measures designed to protect personal information, including encryption in transit and access controls. No system is completely secure, so we cannot guarantee absolute security. Keep your sign-in credentials safe, and contact us immediately at hi@superscenic.app if you suspect unauthorized access to your account.
7. International Data Transfers
We are based in the United States, and your information is processed and stored on our servers in the United States. If you use the Service from outside the U.S., your information will be transferred to the U.S., where privacy laws may differ from those in your country.
Where we transfer personal information from the European Economic Area, the United Kingdom, or Switzerland, we rely on appropriate safeguards, including the European Commission’s Standard Contractual Clauses (and the UK and Swiss equivalents) with our service providers. 8. Additional Information for the EEA, UK, and Switzerland
If you are in the European Economic Area, the United Kingdom, or Switzerland, we process your personal information on the following legal bases:
- Performance of a contract — processing needed to provide the Service under our Terms of Service: creating and managing your account, generating 3D content for your scenes, hosting your content and sharing it at your direction, managing credits and subscriptions, and sending service-related communications.
- Legitimate interests — processing for our legitimate interests in operating, protecting, and improving the Service, balanced against your rights and interests: keeping the Service secure, preventing fraud and abuse, enforcing our terms, establishing, exercising, or defending legal claims, and debugging and improving the Service.
- Consent — where we ask for it. You can withdraw consent at any time.
- Legal obligation — processing necessary to comply with our legal obligations, such as tax and accounting requirements and responding to lawful requests.
In addition to the rights in Section 5, you have the right to lodge a complaint with your local data protection supervisory authority (in the UK, the Information Commissioner’s Office). We would appreciate the chance to address your concerns first — you can reach us at privacy@superscenic.app.
9. U.S. State Privacy Rights
If you live in California or another U.S. state with a comprehensive privacy law, the rights described in Section 5 include your rights under those laws to access, correct, delete, and obtain a copy of your personal information. We do not “sell” personal information or “share” it for cross-context behavioral advertising as those terms are defined under California law, and we do not use or disclose sensitive personal information for purposes other than providing the Service. You may exercise your rights, or appeal a decision we make about a request, by emailing privacy@superscenic.app.
10. Children
We do not knowingly collect personal information from anyone under 18. If we learn that we have collected personal information from a person under 18, we will delete it and close the associated account. If you believe someone under 18 is using the Service, contact us at privacy@superscenic.app.
11. Changes to This Policy
We may update this Privacy Policy from time to time. If we make material changes, we will notify you before they take effect — for example, by email or an in-app notice — and update the effective date above. The current version will always be available in the app and at superscenic.app.
